When Is Too Young?

You need to answer all of the questions within the following post.  Please be thoughtful and take your time.  Do not forget to sign it with your first name and last initial.  This counts on this semesters grade.  Read the entire post prior to posting your answer.  You may want to write it out first.  Please proof read your answer prior to posting.  Even though this is an opinion piece short non well thought out posts will be graded down.

Recently you watched a video in which an 8 year old girl killed an elderly woman.  At 8 years old does she as an eight year old have the capacity to understand her actions?  Should this child go to trial?  If so and she is found guilty what should her punishment be?...or should she be punished?  What about giving her mental health counseling?  She is too young to be tried as an adult so the longest she could be incarcerated would be through the age of 21.  Would she come out rehabilitated or worse for wear?  Finally, please post what you do as a judge in the case.  You as a judge have to decide if you would send her to trial if not you still have to recommend what you believe this girl should receive in response to this crime.

  1. I think she needs some counseling or something. I mean all that over a cat. She may not have intended to kill her but she knew enough to have her sister run while she attacked her. She needs some kind of help. i wouldn't send her to prison though shes just too young.

  2. I think it depends on the motive and the child's reaction to their actions. Some kids wouldn't understand and would genuinely feel bad/scared about it. I don't think it is nessicary to put the child on trial, but they should definately be punished somehow for their actions. I think the best possible punishment for children would be to have to go to a mental health hospital or counseling.I think if you put a 8 year old girl in jail for that long, she would come out much much worse than before.If I was the judge, I would't send her to trial, but to see a counseler that could help her distinguish right from wrong and the consequences of her actions.

    I think she should have counseling and if she does not get any better by the time she's sixteen then she must stay in counseling. If she is released at sixteen and she commits another crime she will be tried as an adult.

  4. I think the little girl should get a trial, but not go to prison. She should get counseling, so that she knows what she has done wrong and why it was wrong. She has to learn why she can't just kill people when she doesn't get what she want.
    I feel like the parents should get involved and the whole counseling too. Clearly, they did something wrong, when their 8 years old child decides to kill an old lady, that is weaker than she is,because she doesn't want to give her a cat.
    I don't even think it is the fault of the girl. I mean obviously she did the decision, but maybe that's how she learned to solve problems.

    I do not believe that most eight year olds know the consequences of their actoins. This is especially true with murder. An eight year old probabaly does not realize the consequences of killing someone. This being said, I do believe she should have a trial and be charged as a jouvenile and be sentenced until she is 21. She should have counseling on top of that. The counseling will help her realize that what she did is wrong and realize the consequences of it. This counseling will aid in her recovery outside of just jail time and help her take preventative measures to avoid crime in the future. I believe that she would come out better if she was sentenced with counseling. If I were the judge, I would sentence her to prison until she was 21 with health counseling.

  6. I think that she should not be trialed. She's to young to go through all of that, and won't know what she's supposed to do. Maybe if she was in her teens then yes put her through a trial but since she's only 8, no. The girl didn't know what she was doing, and she should be put into counseling for help.

  7. I think that a child so young doesn't understand fully what they did. They don't understand that they can be put in jail for the rest of their life. I think that she should get mental help.

  8. At the age of eight years old, she knows the difference between right and wrong. SHe knows what she did to the old woman, and that it was the wrong thing to do. She needs to know that she has to be punished. She should be admitted into a children's mental hospital to rehabilitated herself. She should be tried to determine how many years she is to be in the hospital.

  9. I think that according to what was shown as the clip on CSI of what the girl did, even though she is only 8 years old, clearly she knew what she was doing. She handed the cat to her younger sister, and told her to run. And she attacked the old cat lady with a pen. She clearly stabbed her with the pen, it wasnt an accident, and she knew. She knew to the point where she told her sister to lie about it, cause she knew she would get in trouble otherwise. I think she should go to a trial, I mean it was over a cat. I think she should go to trial because she did kill a full grown woman. If she was foiund giulty, I think she should get some mental help, then go to a junivile jail for a couple years. She should get mental help, cause she did kill just over a cat. I dont think she should get tried as an adult, because she is 8, but she should get tried cause she knew what she was doing, and she knew it was wrong. I if I was the jugde, and I knew she was giulty, I could find her guilty, and send her to a mental hospital to get some help, and then sent to a jevinille jail until she is 18.
    Even thouhg she is 8, she knew what she was doing, and she knew it was wrong.

  10. Since she was 8 years old, most kids that age are aware of their actions and what they are doing. She killed an innocent woman because she couldn't keep a cat. She obviously has some problems mentally and she should get help for that. If I was a judge I would have her get help until she was a teenager then send her to juvi. She deserves the punishment for her actions.

  11. If I were a judge, I will giving her mental health counseling. As an eight year old girl,she may not know what is so bad about killing people, but if she can kill that old lady intentionally just because she wants cat. I think she can do a lot more than that in the future if she did not receive anything in response to this crime.

  13. In my opinion she should be sent to trial, because she can't just kill an old woman. Even though she's 8 she shouldn't be able to get away with that. I mean it's pretty obvious that her mother taught her not to kill someone, in addition she killed the lady because of a cat, so there was no reason like self-defense! She should probably not go to jail or something like that because she's still young but she should go to psychatry and after that the doctors will see if she's good and if not she should go to jail by the age of 18.

  14. 1. yes this girl knows what she is doin plenty well. when you stab somebody in the heart with something that person will most likely die.
    2.yes she should go to trial by no means should she be tried as an adault but be sentanced to some sort of prison or jail time off alone so that she cannot be harmed by any of the other inmates or anybody.
    3.he punishment should be either jail or death penalty depending on the state.
    4.if she goes to jail then she should have mental counseling
    5.i feel that she would come out better than she went in
    6.as the judge i would say that she be held to the age of 21

  15. there is a diffrent way to go about this i believe. I think 1. she should have psychological exams to see if she fits character traits of a psychopath. 2. have immediate psych help. 3. have the case suspended due to lack of ability to prosecute.
    So basically i believe that you shouldnt be able to prosecute in some cases, but will be later and you will have to examine the persons mental state after treatment. Just because they are not in a federal prison doesnt mean that they werent imprisoned. So how long they spent in the mental facility should be counted for their sentece. Zachariah J.D. Converse

  16. first off, this eight year old girl told her sister to, "Burn in hell." She knew what she was doing. She may be young, but that does not make it okay to kill someone. She shouldn't get special priveleges because she is 8 years old. I think this young girl should seek psychiatric help. after a few years of this, i think she should go to juvie, and eventually jail. Murder is a crime. She should be charged as an adult.

  18. Although the 8 year old is underage she is still old enough to know the difference of right and wrong. She knows that murder is not ethical and she should be sent to juvinel detention. Thearpy should be given so she can solve through her obvious urgent problems. When she is old enough and it is clear that she is cured, she could maybe be released on parole.

  20. The little girl is only eight years old and does not have the knowledge to understand her actions. The girl shouldn't have to face trial, however, she does deserve to be punished for her crime. She should be placed in a juvenile center and given mental health treatment. If she were to be let out at the age of 21, i feel that she would be worse then she was when she was eight. As a judge i would rather have her placed in a mental health facility and be treated until the age of 18 then be released.

  21. I believe she is old enough to understand the consequences of her actions. I believe that she should be punished, and she should just have to be put in a juvenile detention center until she is 21. While she is in there she should be visited by counselors and doctors to help monitor her progress. The correctional system is designed to aid in the assistance of growing the young and the old and helping teach them what they did was wrong. She will come out a better person than she was.

  22. No, at 8 years old she does not have the capacity to understand her actions. She just wanted a cat and did not understand that she killed the lady who wouldn’t give it to her. She should not go to trial but she should receive help so she understands her actions and teach her what is right and wrong. She should get counseling because there is something wrong with her if she went far enough to stab someone. If she was incarcerated then she would come out worse. By not going into juvenile detention, she receives love from her mom and sister. If she goes to juvenile detention then her life would completely change and she would adapt to life in there and not be able to succeed outside of jail. If I was the judge, I would not send her to juvenile detention but recommend mental health counseling until she is 18. This would help her so she does not think this is right and make sure she doesn’t do anything like this again.

I believe that this particular 8 year old girl knew exactly what she was doing because she told her little sister to "burn in hell", and held the truth from the detectives by twisting it and putting the blame on her mother. She was very believable. I think that this child, should go to trial AND have psychological exams done on her and alot of counseling because there was obviously something wrong with her mentally. If this little girl was incarcerated until the age of 21, i think because her little sister ratted her out, she would probably seek revenge on her (given her mental problems.)I believe this little girl doesnt think she did anything wrong, and has no remorse for what she did, only sadness for getting caught in the act. As the judge, i would send her to trial. In response to this crime i would give her mandatory counseling and psychological evaluations, also i would send her to prison (because she knew what she was doing) until the age of 21.

  24. This girl is obviously a sociopath, she was knowingly lying to cover her tracks and her and her sister concocted a plan to try and put the blame on the neighbor woman. She knew exactly what she was doing and how she was going to cover herself up. Even after she was found out she pushed the blame onto her mom, this girl is cray and needs to be put to rest, in a jail cell, not killed lol. But she should be tried as an adult because there was obvious thought that went into the deed after she did it and during the process.

  25. I think the entire situation of the little girl murdering the old woman all depends on who her parents are. When you're young, your parents should teach you right from wrong and when they don't teach you those values, that's how those things could happen. From watching the episode, it seemed that her mom did in fact teach her daughter right from wrong but her daughter wanted the cat so in that she just snapped and killed the old woman for the cat. The little girl probably didn't mean to kill the old woman, she was probably in shock once she saw that she was dead. I don't think it needs to go to trial, but the little girl should be put juvenile detention, have therapy, and be closely evaluated until she is old enough to be able to live on her own. When she is finally out on her own, I believe she should have someone close to evaluate her so she doesn't make the same mistake again.

  26. I think in that episode of CSI, that 8 year old girl did understand what she did. It seemed like she had the capacity to understand what she did and understood that it was wrong. However, I don't think she should go to juvie for quite sometime and she should also go through some major therapy and mental evaluations. She needs to be punished somehow for it otherwise she won't learn anything other than the idea that she could get away with something like that again. I feel with the proper care and measures she would be wiell rehabilated and move on knowing it was horrible what she did.

  28. No she doesnt have the capacity to understand her actions. She should not go to trial because she is too young to go to trial. If she were to be incarcerated then she would come out worse than before. The girl just wanted a cat, but she did take it too far by stabbing the lady just to get a cat. As a judge, I would not send her to a juvenile detention center. I would just have her go see a counselor until she is 18. I would have her see a counselor to make sure that she doesnt do something like this again.

  29. Sometimes young people (people under 10) can do something really bad when they are angry or upset . I think she understand what she is doing , but she don't know what would happened if she killed the old woman . She don't have to go to trial or punished , when the time goes by she will forget it and when she grow up , she will learn laws that what she should do she shouldn't do . If I am the judge , I won't sent her to trial , but she will have to learn what the punishment will be if she do it again .

    I think that eight year old children do not have the capacity to understand all of their actions. They can understand simple things like not eating cookies before dinner, but murder is a very complex concept. I think that she should go to trial; she obviously needs help. However, she does not need to be punished with incarceration. She should go somewhere to get help. Mental health counseling would be a proper sentence. As a judge in the case, I would make her get help, and I would carefully look at her home life. A young child's actions are directly correlated to their parents and lifestyle. She probably needs a new home.

  31. If i was the judge in court, dealing with this eight year old i would just make her need to get counseling for years, and take certain classes such as something in pine rest. She needs to learn there's consequences to all of her actions.

  32. I think the little eight year old girl knew exactly what she was doing. She took the time to take her pen out of her bag to stab the ederly woman,which goes to show that she obviously understood the consequences of her actions. That child should be sent to therapy for a mental evaluation.

As an eight year old she may not have thourally understood what she was dong, but weather by example or influence she knew that in order to get what she wanted, she neded to get the cat lady out of the way. She did know what she was doing was wrong. She knew that she was stealing that is why she had to get rid of the old lady. In the moment of the murder she may not have thought about if what she was doing was right or wrong that is why she didn't want her sister to tell on her. This is also why she told the forensic team about a shouting arguement between the nieghbor lady and the cat lady; she wanted to draw the attention elsewhere. I think she should go to trial and be sentanced to get mental help and rehabilitation. I feel like her mom didn't discipline her enough, she just let things slide and let the girls do what they wanted. If she did go to jail I feel like it would just make things worse because she would be around criminals until she was 21yrs old, the expirience would pervert and corrupt her. If I were the judge I would send her away to rehab durring the week and being with her family on the weekends. while there they would teach her the diffeence betwen right and wrong. She would be counseled and learn important lessons. For example, stealing is wrong, you cant always get what you want, you should obey your parents etc.

  34. I believe that the eight year old girl was aware of her actions. Most eight year olds would understand the difference between good and bad actions. I'd say that the girl should not go to trial, but she should take a psychiatric analysis to determine whether she should be helped through mental health counseling. I think that the girl isn't a very big threat and she should periodically be allowed to see her family. They would help to motivate her to get rehabilitated, instead of getting worse. As a judge I would give her juvenile detention in private quarters and have her perform psychiatric tests daily to try and rehabilitate her.

  35. I do think that this 8 year old girl defintly knew what she was doing. She killed her over a cat, this girl obviously has problems. I do think that she should go to trial, but it is hard to come up with a punishment for an 8 year old for murder. I think that she definalty needs to go to mental health counseling. I think that when she comes out she will be worse. If i was the judge i would sentace her until she is 21 and mental health counseling.
